In criminal prosecutions, a person charged with an offence and required to attend at court to have the matter heard (tried) on a date specified in a summons (for summary offences) or on indictment or presentment (for indictable offences); In civil litigation, a person against whom a claim is filed in a court, who then becomes a party to the proceeding and must defend the claim.
