In criminal law, in circumstances prescribed by legislation, the legal burden on an accused to establish specific reasons why his or her pretrial detention (remand in custody) is unjustified (cf the common law presumption that all accused persons are entitled to bail unless the prosecution can establish reasons why bail should be refused).
