If you’re unsure where your child has been taken, the Court can make what is known as a location order. This allows certain government agencies, such as Centrelink or the police, to provide information that may help identify where your child or the other parent is currently located. Where necessary, the Court can also issue a recovery order. A recovery order authorises the police to locate your child and return them to you or to another person named in the order.

If your concern is that your child may be taken overseas without your consent, there are preventative steps that can be taken. A Child Alert can be lodged to notify the Department of Foreign Affairs and Trade that a passport application should not proceed without further consideration. If your child already holds a passport, their name can be placed on the Family Law Watchlist to help prevent international travel without proper authority.

These processes can feel urgent and complex, but timely advice allows you to act decisively to protect your child’s safety and stability.
