Superannuation & Trusts.

Structured ways to protect what you own, grow it wisely and pass it on with clarity and care.

Making complex structures work for you.

Superannuation and trusts can be complex to understand, but at heart of it they are simply ways you can safeguard what you own. Used well, it can help protect and grow your assets, provide tax advantages and make sure the right people are looked after, without adding unnecessary complication.

With over 100 years’ experience, our trusted lawyers help individuals and families understand their options and put the right structures in place. Whether you’re setting up a family trust, establishing a self-managed super fund, or trying to understand how your existing structures fit into your estate plan, we make the complex straightforward.

Self-Managed Superannuation Funds.

For many Australians, superannuation is their largest asset. If you’ve chosen to manage it yourself through a Self-Managed Superannuation Fund (SMSF), you have more control but also more responsibility to stay compliant with constantly evolving laws.

We can establish SMSFs tailored to your specific needs and circumstances. Whether you’re consolidating super from multiple funds, wanting more control over investment choices, or planning for retirement with your spouse, we ensure your fund is structured correctly from day one.

Here’s something that surprises many people; your superannuation doesn’t automatically become part of your estate when you pass away. The trustee of your super fund has discretion over who receives your death benefits, which might not align with your wishes or your Will.

A Binding Death Benefit Nomination takes that discretion away and directs your super exactly where you want it to go (provided your chosen beneficiary is allowed under superannuation law). We can draft these nominations to give you certainty and ensure your super forms part of your broader estate plan, rather than existing in isolation.

Using trusts to protect & provide.

Trusts aren’t just for the wealthy; they’re practical structures that many families and businesses use to protect assets and manage tax efficiently. At their core, a trust lets a person or company (the trustee) hold assets for the benefit of others (the beneficiaries). For example, a discretionary (family) trust holding investments, a unit trust used for a business venture or customised trust deeds built around your personal or business needs.

We can draft and review trust deeds for a wide range of situations, from simple family arrangements to more complex commercial structures. No matter the complexity, we walk you through the options and explain in plain terms how control works, who benefits and what your options are as life changes.

How trusts fit into estate planning.

Trusts and Wills work together. While your Will directs what happens to assets you own personally, trusts can hold significant assets outside your estate such as your family home, investment properties and business interests.

Understanding how these structures relate is essential for effective estate planning. We help you see the full picture and distinguish what’s in your personal estate, what’s held in trust, what’s in superannuation and how to coordinate everything so your overall plan achieves what you intend.

Advice that brings everything together.

Because trusts and superannuation have important tax consequences, we make sure your legal advice and tax advice work together, not in isolation.

We work closely with you to understand your goals, explain your choices clearly and help you put the right protections in place, always with an eye toward long-term security and peace of mind.
