Common questions we hear.
  • Yes, it is legal to write your own Will in Australia. Any individual over the age of 18 who is of sound mind can prepare their own Will. All you need to do to ensure your Will is valid is make sure that it is:

    In writing: Your Will must be a written document, typed or handwritten.

    Signed by you: Your signature at the end of the document confirms the Will’s validity.

    Witnessed: Two independent witnesses (not beneficiaries or spouses of beneficiaries) must witness you signing the Will and then sign it themselves.

    The challenge isn’t the legality, it’s ensuring it actually works the way you intend. That’s where legal guidance becomes valuable.

  • Some situations really benefit from legal advice, including:

    Owning significant assets or multiple properties

    Having a blended family or complex family dynamics

    Wanting to include trusts or detailed instructions

    Needing to safeguard vulnerable dependents

  • The law has some requirements:

    You must be 18 or over

    You need to be of sound mind when you create your Will

    The Will must be written

    You must sign it in the presence of two independent witnesses who also sign

    Your witnesses can’t be beneficiaries (or married to beneficiaries)

    Get these things right, and your Will stands. Get them wrong, and your Will might be invalid.

  • Life changes, and your Will can too. Got married? Had a baby? Divorced? Purchased property? You should review your Will every few years and after any major life event.
