What qualifies for divorce in WA?

Going through separation is tough, and taking the next step toward divorce can feel overwhelming, but we’re here to help. The process in Western Australia is relatively straightforward once you meet a few key requirements.

To apply for divorce in WA, you and your spouse must have been separated for at least 1 year and one day. One of you also needs to be an Australian citizen or have a genuine connection to Australia as your home. If you’ve been married less than two years, the court might require proof of marriage counselling first. As parents, you’ll need to show suitable care arrangements are in place for any children.

We help you get your marriage certificate ready (including translation if needed), and file everything online through the court’s E-Court portal – whether it’s jointly or solo. There’s a standard court filing fee, and most cases are approved without a hearing. For solo filings, we make sure your ex is properly served at least 28 days before any court date.

Common questions we hear.
  • Once you file your divorce application through the e-Courts portal, you can choose a hearing date, typically scheduled 6-8 weeks later (depending on court availability). A Family Court Registrar reviews your application beforehand, then grants the divorce at the hearing.

    Your divorce becomes final one month and one day after the hearing. For sole applications (where you serve your ex), you may need to allow additional time should any issues arise.

  • You don’t technically need a lawyer. The process is manageable for many on their own. But if property division, finances or children are involved, our guidance ensures everything’s filed correctly and your interests stay protected.

  • Beyond ending the marriage, you may have rights to a fair share of marital property, plus custody or parenting arrangements for children if applicable.

  • No. It’s not advisable to have the same lawyer due to the potential conflict of interest. Each of you should have separate representation to protect your individual needs.

  • WA Family Court aims for a “just and equitable” division, not an automatic 50/50 split. They weigh up your financial and non-financial contributions, future needs and other circumstances to decide what’s fair.
