UPDATE ON WORK, HEALTH AND SAFETY LAWS
HHG Legal Group is mindful that the national ‘harmonisation’ of Work, Health and Safety laws will have a significant impact on many businesses.
The WA Government has committed to a deviation from some aspects of the national model legislation adopted in other states, including lesser penalties in WA, the refusal to adopt reverse onus of proof in discrimination matters, and the retention of Worksafe WA as the relevant body responsible for enforcing the legislation in WA (without the DPP having to review Worksafe’s decisions not to prosecute).
Business currently has the opportunity to comment on the regulations that will govern the implementation of the law in WA. Businesses can make submissions or complete an online survey and we strongly encourage you to do so. The proposed effect of the regulations is set out in relatively simple terms in Part A of the document that is read from the Marsden Jacobs Associates website.
Submissions close 5pm on 12 October 2012. Even if not inclined to make submissions, this is an early opportunity for many business operators to gain a general awareness of the changes that may be introduced.
