Managing Associate, Dr Steve Cohen, will be hosting a substantive law CPD session discussing Trusts in Family Law.
Family Lawyers often encounter parties who have separated where a significant proportion of the marital assets are held in a trust. As the trust is a separate entity, the question arises whether the trust should legally fall within the definition of ‘property’ as defined in the Family Law Act.
There is an increasingly large body of matrimonial case law that deals with trusts in family law.
Topics Covered: Trusts in Family Law
- Property settlements – how they work
- Definition of property
- Trusts as ‘property’
- Effect of trusts on property settlements
- Current state of case law – particular focus on major cases in the last 12 months
